TO WHOME IT MAY CONCERN;

The foregoing appraisal or evaluation is made with the understanding that the Appraiser/Evaluator Sean E. Rich or Tortuga Trading, Inc. or assisting colleagues assumes no liability with respect to any action that may be taken on the basis of the Appraisal or Evaluation.  This is to certify that we are engaged in the Fine Antiquities business and specialize in Antique Arms & Armour, rare coins, jewelry, and precious stones of all descriptions.  We herewith certify that we have this day carefully examined the following listed and described articles.  We estimate the value as listed for insurance and other purposes at the current retail value, excluding Federal and other taxes.  In making any appraisal/evaluation we DO NOT automatically agree to purchase or replace the articles.

The appraiser/evaluator certifies that, to the best of his/her knowledge and belief:

The statements of fact contained in a report are true and correct.
The reported analysis, opinions and conclusions are limited only by the reported assumptions and limiting conditions, and are our personal, unbiased professional analysis, opinions and conclusions.
We have no present or prospective interest in the property that is the subject of a report, and have no personal interest or bias with respect to the parties involved unless, prior arrangements/agreements have been made for out right disposal/purchase.
Compensation is not contingent upon the reporting of a predetermined value or direction in value that favors the cause of the client, the amount of the value estimate, the attainment of a stipulated result, or the occurrance of a subsequent event.
Our analysis, opinions, and conclusions were developed, and certain report(s) has been prepared in conformity with the Uniform Standards of Professional Appraisal/Evaluation Practice or by any means we see fit.
We will make a personal inspection of the property that is the subject of a report/s.
We will include/provide additional colleague/s for professional assistance if necessary.

An appraiser/evaluator must protect the confidential nature of the appraiser/evaluator-client relationship.

Unless otherwise stated, the appraised/evaluated value(s) is based upon the whole interest and possessory interest undiminished by any liens, fractional interests or any other form of encumbrance or alienation.
The appraisal/evaluation is made at the request of the employer named, for his/her/its use for the intended purpose indicated, and is specifically not for third-party use.  It is not an indication or certificate of title or ownership.  The identification of the interest of the employer is simply represented to the appraiser/evaluator by such party and no inquiry or investigation will be made nor is any opinion to be given as to the truth of such representation.
Unless otherwise stated, the appraisal/evaluation is based only on the readily apparent identity of the item(s) appraised/evaluated, and no further opinion or guarantee of authenticity, genuineness, attribution or authorship is made.  The total of the individual item values shall not be construed as an appraised/evaluated value for the whole collection, but merely as the addition of single values.

The value(s) expressed is based upon the appraiser's/evaluator's best judgment and opinion and is not a representation or warranty that the item(s) will realize that value if offered for sale at auction or otherwise.

The appraiser/evaluator assumes no responsibility for unforeseen changes in market conditions or the inability to locate a potential buyer or replacement items at the appraised value, if such is attempted by the client.  The value(s) expressed is based upon current information on the date of the appraisal/evaluation and no opinion is expressed as to any future value or, unless otherwise stated, as to any past value.
The suitability and intended use of an appraisal/evaluation report in its entirety are predetermined and are valid for the stated purpose of the appraisal/evaluation only and considered invalid if used for any purposes unknown to the appraiser/evaluator.
Unless otherwise stated, value(s) expressed is based upon the general expertise and qualification of the appraiser/evaluator as to the appropriate market and valuation for the item(s) and purpose involved.
Where appraisal/evaluation is made on a sample from a larger whole, it is based upon the assumption that the sample is representative of the whole, and is fair.  No opinion or warranty is to be made as to the fairness or representative nature of any large whole from which the sample was drawn.
Unless expressly stated, the condition of the item(s) is good for its type, with serious deficiencies and repairs noted as well as the method of preservation utilized in the framing of any applicable work of art.  Ordinary wear and tear common to this type of item is not to be noted.
In the event legal proceedings are brought to enforce any of the terms of these conditions, the appraiser/evaluator shall be entitled to all representation, reasonable costs incurred including attorney's fees.  The American Society of Appraisers advocates the use of Arbitration for such matters.  If it is adjudicated that the appraiser/evaluator(s) has fallen short of professional standards on one or more items described in an appraisal or evaluation, the amount of the award shall NOT exceed the portion of the total fee that applies to the item(s) in question.
It is understood that neither the employment to make the appraisal/evaluation nor the compensation for the appraisal/evaluation is contingent upon the valuation amount.  Submission of report(s) completes the assignment.  The appraiser/evaluator, by reason of the appraisal/evaluation report, shall NOT be required to give further consultation, testimony, or be in attendance in court with reference to the property in question, unless arrangements for such have been made previously.  All further services pertaining to the subject property appraised/evaluated will be billed at our normal professional rates.
